An Indiana wrongful death lawsuit has been filed by the parents of an 8-year-old boy who was killed at a railroad crossing in 2008. The parents argue that both the country and the railroad company were aware of how unsafe the crossing was.

Linton, IN, Parents Sue Railroad Company Following Fatal Car And Train Wreck

The parents of a young Indiana boy who died in a train-car collision are now suing for wrongful death. The Linton, Indiana, couple named both the Indiana Railroad Company and Greene County in their IN wrongful death lawsuit, claiming that both the train company and the county know about the dangerous intersection where their son, six-year-old Christopher Perez, was hit by a train. They also claim that numerous residents near the train crossing had complained about the dangers of the intersection in the past.

The train crossing at County Road 400 is at the top of a high grade and only had a stop sign to warn cars of oncoming trains. After the train-car accident, blinking lights and railroad crossing arms were added to the intersection. Perez suffered severe head injuries in the Indiana train and car collision and died ten days following the train wreck.
