            <description><![CDATA[<p class="p1">The United States Food and Drug Administration (FDA) recently issued a warning to all people taking the prescription drug dronedarone, sold as Multaq and Sanofi-Aventis.&nbsp;</p><p class="p2">After the FDA recently conducted a safety review of the drug, which is used in patients who suffer from atrial fibrillation, the organization discovered that the medication actually increased the risk of death, stroke, and heart failure in patients with permanent atrial fibrillation.             <title><![CDATA[Indiana’s First Winter Storm Brings with It Traffic Accidents & Injuries]]></title>
            <description><![CDATA[When it comes to winter weather, Indiana had been spared so far this season &ndash; that is, until a major storm slammed the region last week, causing mayhem on the state&rsquo;s roads, highways, and interstates. Although most areas only reported three to four inches of snow accumulation, police say that strong winds and blowing snow caused a high number of serious traffic accidents. All in all, one person was killed in a weather-related car accident, while another resident was critically injured.<br /><br />According to Indiana State Police, the fatal Indiana car accident took place on Thursday afternoon on Highway 33 in Fort Wayne on icy roads. One car slid into an oncoming car in the opposing lane, killing 31-year-old Eric Sitcler of Fort Wayne.<br /><br />Also on Highway 33, a dump truck traveling in Allen County lost control on wintery roads and clipped a tractor-trailer, which in turn collided with an SUV. The driver of the smaller vehicle was ejected from the vehicle and remains in critical condition at a local hospital. The driver of the dump truck left the scene of the accident.             <title><![CDATA[Two Indiana Teens Could Face Charges after Fatal SUV Accident]]></title>
            <description><![CDATA[After a 12-year-old Indiana boy died in a car accident involving an under-aged driver, both the driver and the owner of the vehicle could face criminal charges.<br />&nbsp;<br />According to local news sources, a group of teens was hanging out at a home in Warren, Indiana, on Friday, December 9, when a 17-year-old male gave his car keys to a 14-year-old boy. The teen, along with 12-year-old Cory Downhour and a 13-year-old girl, climbed into an SUV and drove it down a dirt road. The unidentified boy lost control on a stretch of icy road and the SUV fell into a deep ditch. The accident took place just before two in the morning on Saturday.<br />&nbsp;<br />Downhour was pronounced dead at the scene of the Warren car accident. The two other teens both suffered serious injuries, including broken bones, but have since been released from the hospital.<br />&nbsp;<br />The 14-year-old could face a charge of operating a vehicle without a license, while the older teen could face a charge in which he allowed a driving violation to take place.             <title><![CDATA[Indiana Company Faces Fines after Radio Tower Worker Death]]></title>
            <description><![CDATA[After two men were killed during the construction of a radio tower near Colburn, the Indiana Occupational Safety and Health Administration (IOSHA) has concluded its investigation of the fatal worker accident and proposed over $90,000 in fines regarding the worker safety violations it discovered.<p>In April, 32-year-old Paul Aliff and 29-year-old Ernesto Garcia were building the WXXB radio tower in Tippecanoe County as employees of ERI, Inc. when they both fell an estimated 340 feet to their deaths. The IOSHA found during its <a href="http://www.2keller.com/practice_areas/construction-site-accidents3.cfm">Indiana worker death investigation</a> that the company had nine work safety violations, including four knowing violations and five serious violations. Specifically, the company did not provide the two men with adequate fall protection, did not provide a weight limit for the basket the men were working in, and did not have the basket designed by a qualified person.</p><p>ERI responded to the violations and fine related to the Colburn construction site accident by saying that it disagreed with some of the IOSHA findings.             <description><![CDATA[<p><span style="font-family: verdana,geneva;"><br />I attended and was privileged to speak before the <a href="http://www.nosscr.org/antonio.html" target="_blank">November 2011 NOSSCR conference in San Antonio</a>.&nbsp; <a href="http://www.nosscr.org/index.html" target="_blank">NOSSCR</a> (National Organization of Social Security Claimants Representatives) is the premier organization for <a href="http://www.2keller.com/practice_areas/social-security-disability.cfm">Social Security attorneys</a> and it is my feeling that anyone proceeding on a disability claim be represented by an attorney who both is member of NOSSCR and participates in these conferences on a routine basis.&nbsp; <br />&nbsp;<br />The <a href="http://www.ssa.gov/" target="_blank">Social Security Administration</a> always participates in these conferences, providing a sort of status report on how they think they are doing.&nbsp; This conference was a little different.&nbsp;&nbsp;Glenn Sklar, Deputy Commissioner for the <a href="http://www.ssa.gov/appeals/ho_locator.html" target="_blank">Office of Disability Adjudication and Review</a> (ODAR) appeared by video instead of in person, announcing that he had been grounded due to budget.&nbsp;&nbsp;Much of the presentation dealt with "progress" of the agency in decreasing the backlog of cases waiting for hearing, by increasing judge productivity, adding staff, technology with the strong theme that they believed they were doing just great!!&nbsp; He addressed the growing use of video hearings to address backlog, which are controversial the NOSSCR membership.&nbsp;&nbsp;The word expressed over and over was "quality."&nbsp; Sklar announced a goal of 270 days processing time for hearings, however neglected to indicate whether the often lengthy wait for a decision after hearing was included in that number.&nbsp;&nbsp; However, it is clear that the waiting time has been somewhat reduced.&nbsp;&nbsp;What I question is the "quality" of the decision making.&nbsp;</span></p><p><span style="font-family: verdana,geneva;">The information presented next by Patricia Jonas, Executive Director of the <a href="http://www.ssa.gov/appeals/appeals_process.html" target="_blank">Office of Appellate Operations</a> illustrates my point.&nbsp; She is responsible for caseload after a case had been heard by an Administrative Law Judge.&nbsp; If a claimant is still unhappy, they can appeal to the Appeals Council and beyond that to the federal courts.&nbsp; Just in the 2011 fiscal year, Appeals Council filings increased by 34.7%.&nbsp;&nbsp;Really?&nbsp; This is a huge increase and does not support progress and "quality."</span></p>]]></description>

            <title><![CDATA[Illinois Medical Malpractice Information Back Online after Legal Issues]]></title>
            <description><![CDATA[The online database that allows patients to access Illinois medical malpractice information is officially back online after facing months of legal barriers.<br /><p><br />The online Physician Profile website was taken down in 2010 after the Illinois Supreme Court ruled that the new medical malpractice reforms were unconstitutional. However, in August, Illinois Governor Pat Quinn signed a new law, the Patient Right to Know Act. The law allowed the online database to become available once again, while also giving doctors and chiropractors the opportunity to review their profiles and fix any issues or misstatements.</p><p>The database, which patients can access through the Illinois Department of Financial and Professional Regulation's website, allows visitors to search the profiles of 46,000 medical professionals in Illinois and review their history of disciplinary action and medical malpractice.             <title><![CDATA[Illinois Supreme Court Reverses Car Accident Lawsuit Decision]]></title>
            <description><![CDATA[The Illinois Supreme Court has reversed an earlier jury decision regarding a $43 million product liability case against Ford Motor Company. While a 2005 court case concluded that Ford's Lincoln Town Car suffered from a dangerous design flaw, the Supreme Court judges disagreed.<br /><br /><p>In 2003, Dora Jablonski and her 73-year-old husband John Jablonski, were traveling on the highway when they stopped for road construction traffic. A distracted driver rear-ended their vehicle traveling between fifty and six miles per hour, causing an object in the trunk of their car to pierce the gas tank. A car fire resulted, killing John and severely burning Dora.             <title><![CDATA[Muncie Family Sues After Doctor Gives Baby Unwanted Circumcision]]></title>
            <description><![CDATA[An <a href="http://www.2keller.com/practice_areas/medical-malpractice30.cfm">Indiana medical malpractice trial</a> will begin on Monday involving a Muncie family whose son underwent a circumcision surgery against their wishes. <br /><br />The Delaware County medical error trial will begin on October 3, when a jury will hear both sides of the story. The mother of the baby boy in question will argue that her doctor knew that she did not approve of the procedure but went ahead with the unnecessary and elective surgery anyway. The physician defendant in the medical malpractice case, Dr. Michael Burt, said that he did not simply ignore the family&rsquo;s wishes and force a circumcision on a baby. <br /><br />The Muncie medical malpractice case was filed eight years ago.             <title><![CDATA[I-65 Truck Accident in Indiana Shines Spotlight on Highway Hypnosis]]></title>

            <title><![CDATA[Actos clinical study reveals possible heart risk]]></title>
            <description><![CDATA[<span style="font-family: verdana,geneva;"><br />Dr. Steven Nissen, a world-renowned cardiologist of the <a href="http://my.clevelandclinic.org/default.aspx" target="_blank">Cleveland Clinic</a>, was chosen to conduct studies based on claims that Actos was causing serious heart problems in patients.&nbsp;<br /><br />The&nbsp;results that Dr. Nissen was particularly critical of&nbsp;is contained in&nbsp;the <a href="http://jcem.endojournals.org/content/91/1/25.full" target="_blank">PROactive study</a>.
