Cook County Truck Accident Results In $1.5 Million Wrongful Death Settlement

Trucking industry new site LayOver.com reports that a Chicago woman's family has received almost $1.5 million in a wrongful death settlement with the truck company, the city where the accident took place, and the truck driver himself.

The incident occurred on August 25, 2004, when 49-year-old Debra Jean Cunningham was driving her car in Danville, Illinois. A thunderstorm had taken out the traffic lights at an intersection, and town officials had replaced the lights with a non-reflective stop sign placed in the wrong spot in the intersection.

Cunningham stopped at the makeshift sign and then continued through the intersection, where her vehicle was struck by an oncoming truck. She was killed upon impact with the truck. The truck, owned by Dayton Freight Lines and driven by Henry Butler, did not stop at the broken intersection although the driver was familiar with the area and route. The intersection is located at the meeting of Vermillion Street and Lakeshore Avenue.

During the wrongful death case, Cunningham's wrongful death attorney proved that the sign was insufficient and that the truck driver should have know to stop despite the broken traffic lights. Judge Michael D. Clary approved the settlement.

PRWEB reports that the wrongful death settlement was the largest for a car and truck accident involving the death of a female in Vermillion County.

Cunningham is survived by her husband of 22 years, five children, and a number of grandchildren.
