Decatur Jury Awards $6.7 Million To Family Following Construction Accident

The parents and siblings of an Illinois construction worker has been awarded with $6.7 million in damages after their loved one was killed in a Decatur construction site accident in March 2007.

The Illinois jury decided last week that Decatur construction company Archer Daniels Midland was responsible for the construction site death of 26-year-old Francisco Moreno Garcia.

According to reports, Garcia was insulating pipes at an Archer Daniels Midland (ADM) facility when a machine broke, spraying the worker with steam, toxic chemicals, and boiling water. Garcia was rushed to a nearby hospital where he died the next day from severe burns over the majority of his body. While working his construction job, Garcia was harnessed to a 15-foot high scissor lift that was situated near a recompression evaporator. The evaporator, which contained hot liquid waste, exploded, spraying Garcia with its contents. Garcia tried to escape his harness, but could not get it off.

"As they stripped his clothes off him to get him into the safety shower, his skin was just peeling off in strips," the family's construction accident lawyer said.

ADM is not sure whether or not it will appeal the Illinois court decision. ADM spokesman Roman Blahoski expressed sympathy to Garcia's family and said that they are considering how to move forward regarding the outcome of the construction accident case. Until then, the Macon County Court's wrongful death decisions stands regarding the chemical burn lawsuit.
