Dog Attack In Marshall County Reveals Indiana Dog Bite Policies

How much do Indiana counties differ when it comes to how dog bites are handled? For Jennifer Smith and her son Bobby, the answer is, far too much. When 8-year-old Bobby Smith was attacked by a potentially aggressive dog last week, no one came to take the dog away even though Bobby was rushed to a nearby Indiana hospital for 19 stitches for the dog bite wounds on his chin, hip, and arms - wounds that could leave physical and emotional scarring.

In Marshall County, where the family lives in Argos, the local Humane Society is not responsible to pick up aggressive dogs - even if they have seriously wounded a child. The Marshall County Sheriff's Department also doesn't handle much in the way of dog bite cases - the dog can be quarantined (which is required by Indiana state dog bite law) either in a shelter or at the owner's home. No other county-level ordinances stand for the treatment of dangerous dogs.

The owners of the aggressive dog in this case are quarantining their dog at their home and plan to put the dog to sleep after the quarantine is over. At the time of the dog bite attack, the dog was not current on its rabies vaccine. Even still, the Humane Society is meant to shelter stray dogs, not aggressive ones. No one checks up on the aggressive dog during a home quarantine - and Jennifer Smith will have to decide whether to put Bobby through a series of painful rabies shots.
