Families File Lawsuit Against Indiana After Deadly Fair Stage Collapse

Just over a month after a deadly stage collapse at the Indiana State fair, a woman has announced her plans to file a personal injury and wrongful death lawsuit against the state of Indiana, who she thinks was responsible for the death of her same-sex partner and for her serious injuries.

The federal lawsuit includes two very large challenges: it will attempt to overturn Indiana’s $5 million cap on damages for any single event, and it will attempt to secure compensation for a spouse in a same-sex civil union that took place in Illinois but which is not recognized in Indiana.

On August 13, Alisha Brennon and her spouse Christina Santiago were waiting for Sugarland to play a concert at the state fair. But just minutes after a severe thunderstorm rolled in, the state collapsed onto the audience, killing seven people and injuring 40 more. Santiago, a gay rights activist, was killed in the accident while Brennon suffered a number of injuries, including a head injury, that were still apparent this week when she announced her lawsuit.

Brennon and her personal injury lawyer believe that the State of Illinois did not do nearly enough to ensure that the state was safe or that the audience would not be harmed. She also believes that it is simply unfair to cap damages on all accidents, no matter how many people are injured and killed due to negligence.
