Flint Michigan Woman Sues Doctor After Alleged Forced Abortion

Posted on Jun 12, 2010

A Flint, Michigan, woman is suing her doctor after she asked him to stop performing an abortion while on the operating table. The medical malpractice lawsuit she has filed lists seven counts, including lack of informed consent, battery, misrepresentation, intentional infliction of emotional distress, gender intimidation, and violating the Elliot Larson Civil Rights Act.

According to 20-year-old Caitlin Bruce, she was in Feminine Health Care Clinic on the operating table when her doctor, Dr. Abraham A. Hodari, began her scheduled abortion. However, as he began, she asked him to stop after seeing an ultrasound of her baby and he did not. Instead, she says that he ignored her and had a nurse hold her down as he finished the procedure. In the weeks following the event, she attempted to commit suicide and has been emotionally scarred.

According to Dr. Hodari, the woman asked him to stop the procedure after he had already begun, and stopping the operation would have led to a serious infection and put his patient in danger. He puts forth that he only wants women to have safe abortions.

Another obstetrician that was consulted opined that there were better options than holding the woman down, and if the procedure was partially done, she should have been transported to a hospital for treatment and a second opinion.

This Michigan medical malpractice case was filed in Genesee County Circuit Court on May 24, 2010.
