Gary Doctor Mark Weinberger Faces First Of Hundreds Med Mal Lawsuits

The trial of notorious nose doctor Mark Weinberger begins this week in Merryville, Indiana. Weinberger, who fled the country after having over 350 medical malpractice lawsuits filed against him by patients, is first facing an accusation of unnecessary surgery on a patient who is suing for pain and suffering.

While all parties agree that medical malpractice did take place, the trial is on to pinpoint the appropriate amount of compensation for the incident, which involved 59-year-old William Boyer of Gary, who went to see Weinberger because he suffered from sinus problems.

According to the Post-Tribune, Weinberger performed nine surgeries on the patient in question, totaling $42,000. One procedure involved drilling holes in the patient’s sinuses, leaving permanent damage as well as a fear of doctors and medical procedures.  Finally, Weinberger fled the country and left his patient to fend for himself while he ran from authorities. He was captured in 2009 while hiding out in Northern Italy.

His medical malpractice accusers say that Weinberger routinely misread CT scans and x-rays, often performed unnecessary surgery, and used obsolete techniques on patients causing long-term damage and emotional trauma.

Weinberger will not attend this civil trial or any other medical malpractice trial as he is currently in prison awaiting his criminal trial – for which he faces 22 different charges. However, his ex-wife may attend part of the medical malpractice trial through a video conference.
