While many are familiar with common birth injuries like cerebral palsy, there are a number of ways that a child can be harmed during birth and labor because of the careless or negligent actions or hospitals, medical centers, doctors, and health professionals.
This week in Illinois, a family received a $29 million medical malpractice birth injury lawsuit settlement in regards to their quadriplegic son. The Illinois birth injury lawsuits involved both the hospital where the birth took place and the doctor who oversaw the delivery.
In 2003, Christian Arroyo was born in the Northwestern Memorial Hospital in Illinois. His mother, Maria Arroyo, had her water break early – a dangerous event that can lead to an infection in the baby if antibiotics are not administered. However, the federal employees of the hospital did not treat mother or child for a possible infection, although the baby continued to display signs of the problem in the days after its birth. Without treatment, the infection spread through the baby’s body and eventually attacked the child’s brain. By the time the infection was stopped, Christian had suffered severe brain damage and was paralyzed from his neck down.
The couple’s Illinois birth injury lawyer argued that neither the hospital or the doctor followed an appropriate standard of care for the mother and her newborn son, turning a normal, healthy boy into someone who will require around-the-clock care for the rest of his life.
U.S. District Judge Amy St. Eve awarded the family with $22.6 million, which is in addition to a $6.5 million 2009 settlement with the hospital.
