Biomet, an Indiana-based medical device manufacturer, has settled a medical malpractice lawsuit with 24 injury victims who were harmed by one of the company's medical device products. All in all, 27 different medical malpractice lawyers have filed medical malpractice lawsuits in regards to the use of this defective product.
The product in question was the Ionic Spine Spacer System and SpF and OsteoGen impants - and the surgeon in question was osteopath doctor John King. King, who has faced a slew of medical malpractice lawsuits across the country in the past few years, has been accused of seriously injuring or killing roughly 120 patients in six months who received EBI-manufactured bone simulators.
Although Biomet has agreed to a settlement, both the medical device manufacturer and their subsidiary, EBI, admit to no wrongdoing in the patient injuries and fatalities. Business Week reports that final approval of the settlement agreement will come from the Putnam County court system shortly. Releatedly, a federal lawsuit that alleges that EBI improperly marketed its devices through an illegal kickback scheme that involved King and defrauded federal health care programs has now been dismissed.
Eleven of the original 33 lawsuits against Biomet and EBI were dismissed.
King has since surrendered his medical license and has since had a bankruptcy filing rejected. He still faces dozens of medical malpractice lawsuits - and both he and the hospitals where he works have already paid out $100 million in medical malpractice damages.
