Indiana Parents Sue Botox Company After Daughter Dies

Following a number of similar wrongful death defective drug lawsuits appearing around the country, an Indiana family has filed a wrongful death lawsuit against Allergan, Inc., the makers of the drug Botox. Although Botox is traditionally used to treat wrinkles and other signs of aging, many health professionals also use the drug in high doses as a therapy to help children suffering from cerebral palsy. Many think that the drug helps ease the muscle spasms associated with cerebral palsy, however, the drug has not been approved for such uses.

Indiana couple Brandon and Jill Well have filed the wrongful death lawsuit regarding their 10-year-old child Audrey. The girl died just days after receiving the Botox treatment, which can be dangerous in high doses due to the paralyzing nature of the medication that can affect breathing. The girl’s parents said that no one warned them about the possible deadly side effects of the Botox treatment and that no one told them that the FDA had not approved the drug to be used in that capacity. In addition to suing the company that manufactures Botox, the family is also suing the doctors who gave the treatment, all of whom are employed at the Riley Hospital for Children.

Adverse effects from high doses of Botox have been widely reported, especially when the medication is used to treat muscle spasms in high doses. Medical professionals believe that the Botox travels away from the injection site and paralyzes the respiratory system. Last year, the FDA added a black box warning to Botox regarding the dangers of using the drug for cerebral palsy and noting that patients could have trouble breathing and swallowing. Over a dozen families have filed lawsuits again Allergan, Inc.
