Medical Review Board Finds South Bend Medical Responsible For Death

An Elkhart Superior Court jury and an Indiana Medical Review Board both agreed that an Indiana family deserved compensation in a tragic IN medical malpractice case. After a three-person medical review board and a standard jury heard the case, which involved the missed diagnosis of cervical cancer in an Elkhart woman, the woman’s surviving husband and 12-year-old sons will receive $1.2 million in damages. The husband will receive $200,000 while each son will receive $500,000.

The medical malpractice incident took place in 1998, when Elkhart resident Nicole Manhar went in for a pap smear. The technician who read the pap smear slide declared it normal, but the medical review board agreed that abnormal and pre-cancerous cells were visible. Manhar died two years later of cervical cancer, which progressed aggressively after not being detected.

After her death, her husband and sons filed a medical malpractice lawsuit against South Ben Medical Foundation for their mistake. When the jury’s decision was announced, Dr. Robert Tomec, president and medical director of the foundation, agreed it was a tragic case but did not agree with the jury’s decision. He said that he could understand how the jury would have been emotionally affected by the story told during the trail. He also alluded to a national expert who said that the pap smear was normal.

Having a medical review board look over medical malpractice cases before they go before a jury is a new practice in Indiana.
