Michigan Man Sues Over Elderly Woman’s Nursing Home Falls

A man is suing a Belleville, Michigan, nursing home for nursing home negligence after the man's relative died of complications from a fall she suffered while in the assisted care facility.

James E. Golliday claims that Eldercare, Inc., the nursing home that cared for his friend, knew about Dora Haskins-Bond's susceptibility to falls and should have protected her against future falls during her stay at the adult care facility.

Records show that Dora Haskins-Bond fell at Calvin Johnson Care Center on July 7th, which lead to fractures in both of her legs. Records also show that Haskins-Bond had a record of falling at the same center as well as a number of health concerns that could lead to falling - and that the staff at the nursing home should have been aware of the risk of falls for the elderly woman.

The nursing home neglect lawsuit was filed at St. Clair County Circuit Court on June 8 2009. Calvin Johnson Care Center, Eldercare's administrative manager, Steven Wolf, and Prudence Wolf, who had an ownership interest in the company, are implicated in the lawsuit.

In eight different counts, Golliday puts forth that Haskins-Bond had to unfairly deal with the consequences of her falls - including medical bills, physical pain, emotional pain, disability, and disfigurement. In addition, the woman lost enjoyment of life. All in all, Golliday is seeking $400,000 in damages for the slip and fall plus attorney's fees. His lawyer hopes to prove that the nursing home should have been aware of Haskins-Bond as a fall risk and taken a number of preventative measure to keep her healthy and safe.
