New Mexico Prison Health Care Provider In Court For Medical Malpractice

Posted on Aug 11, 2009

According to the New Mexico Independent and the Albuquerque Journal, a New Mexico inmate has filed a medical malpractice lawsuit against a former corrections department contractor.

This New Mexico medical malpractice lawsuit has been filed by 52-year-old Martin Valenzuela, who says that during his 8-year stint at the Los Lunas prison in Santa Fe, he suffered from inadequate medical care during a health emergency.

Valenzuela suffered from a urinary tract infection in 2006 that led to complications, surgery, and follow-up medical needs. He says that the department contractor, the prison, Corrections Secretary Joe Williams, and involved medical professionals were to blame for poor medical care, lack of medical attention, lack of follow-up medical care, and the loss of his medical records.

Wexford Health Sources Inc. has been accused of providing poor medical care to New Mexico inmates in the past. In fact, another lawsuit filed by New Mexico and Los Lunas prison inmate Michael Crespin filed a medical malpractice lawsuit last year over his mistreatment and lack of treatment after his colon cancer diagnosis. However, Crespin died before he could videotape a deposition and the New Mexico malpractice suit has been mired down by technicalities.

A bevy of other medical malpractice lawsuits have been filed against Wexford and other New Mexico Correctional Medical Services employees. Four women have alleged that they were raped while under care, while the family of an inmate who died while under their care has filed a New Mexico wrongful death lawsuit. State and federal audits have revealed that Wexford has multiple issues when it comes to delivering proper care to inmates.
