After suffering serious injuries in a car accident in Michigan that was not his fault, an Indiana cab driver is suing his insurance company, who says that it is not responsible for the man’s $350,000 in medical bills because he was driving a taxi out-of-state at the time of the crash and did not have insurance for the car.
According to the Niles Daily Star, 62-year-old Phil Hempel was driving his taxi in Buchanan when another car turned left directly in front of his vehicle. His taxicab struck the passenger side door of the car, seriously injuring him as well as the two people in the car he hit. Hempel was rushed to the hospital, where he was treated for broken ribs, a crushed right leg, a shattered arm, and torn ligaments. Since the car accident, which took place in October 2010, Hempel has had two surgeries and requires at least one more. He is still in a wheelchair and needs physical therapy and rehabilitation three times a week. At the moment, his car accident injuries have cost him $350,000.
The driver of the other car, 21-year-old Justine Nsumba and her 18-year-old passenger Dashonda Anderson were also injured in the crash. Nsumba was at fault in the accident for turning in front of the cab driver.
Hempel filed a claim with his insurance company, Farm Bureau of Michigan, who initially agreed to pay. However, when the insurance company discovered that Hempel owned the car because he drove it so often in Michigan, though he did not have insurance for the car. Hempel found himself in a Catch-22 – and without any money to pay his medical bills. He is now suing the insurance company.
