Your Claim Has Been Denied
What is the next step? From here on out the Social Security appeals process can become complex and is often too much for an individual to handle on their own. You may, on your own or with the help of an attorney, put in for reconsideration. A reconsideration consists of the disabled party submitting any evidence, including any new evidence, for review. This review can end in a new decision, where you will be given your benefits, or your claim may be rejected again.
The Next Step Is a Hearing
If you are rejected after a reconsideration the next step is to go in front of an Administrative Law Judge for a formal hearing. This judge will look at all of your evidence, new and old, and come to a decision. If the decision is not in your favor, you may continue to appeal.
The Appeals Council Will Review Your Case
The Social Security Appeals Council may decide to uphold the Judges’ decision, issue their own decision, or send your case back to the Administrative Law Judge for a new decision. Any of these scenarios may not end with a positive result for you. In this case you will have to file a civil suit.
A Civil Suit is Your Last Chance
When all of the above steps have been followed, and you still have not gotten an approval for Social Security disability, you may file a civil suit in Federal District Court. Hopefully, you will not need to get to this point.
