No fee is paid unless and
until you win.
Representation in Social Security cases is overseen
by the Social Security Administration. All fees must
be approved by the Social Security Administration
as part of the process when a case is won. The federal
rules allow fees to be charged the equal 25% of any
back benefit you receive, with a maximum fee cap of
$5,300 for representation in front of the agency at
administrative hearings. In complex cases that take
a longer path to win and move into and through the
Appeals Council and Federal Courts, attorneys are
allowed to petition the Social Security Administration
for increased fees. Keller & Keller typically
would seek 25% of the back award without limitation
at these levels. In the rare winning case where there
is no back benefit awarded, attorneys can also petition
the agency to approve a fee.
