SANTA FE, NM - Authorities said a Santa Fe man is facing a criminal charge in connection with a crash that occurred three years ago, the Santa Fe New Mexican reports.
61-year-old Benito Martinez is accused of driving under the influence in the October 2021 collision in which the other driver, a woman, was seriously injured. He is now facing a felony count of inflicting great bodily harm by vehicle.
According to the report, Santa Fe police initially attempted to file a criminal complaint the month after the crash but it was not received by Santa Fe County Magistrate Court. The charge was filed against Martinez after a follow-up investigation into the case.
Investigators have determined that Martinez's blood-alcohol level was over the legal limit at the time of the crash. They added that the other driver most likely had her headlights on, even though Martinez claimed she was driving without the headlights on.
