New Mexico's Statute of Limitations For Filing a Claim
Our state's personal injury laws contain very strict timelines associated with personal injury claims. Known as your "statute of limitations," this is the time period that dictates when your personal injury claim expires.
The time period a person has in New Mexico can vary based on factors such as age and accident details. We will advise you of your statute date based on the circumstances of your particular injury and accident. You can read the full text of New Mexico's statute of limitations in Ch. 37, Art. 1, Sec. 37-1-8 of the New Mexico Statutes.
In New Mexico, the statute of limitations varies depending on the type of case. Here are some examples of the statute of limitations in New Mexico:
- Personal Injury: 3 years from the date of the injury
- Medical Malpractice: 3 years from the date of the injury or 1 year from the date the injury was discovered, whichever is later
- Fraud: 3 years from the date of the fraudulent act
- Property Damage: 3 years from the date of the damage
- Breach of Contract: 4 years from the date of the breach
- Wrongful Death: 2 years from the date of death
It's important to note that the statute of limitations may be different for certain types of cases. In addition to the time limits associated with your case, we strongly encourage you to hire us before evidence disappears, a witness's memory fades, or the insurance company begins calling to request recorded statements and/or asks you to sign medical authorizations.
