The number of accidents that occur in Muncie will surprise you: During a three-month period in the spring of 2014, the city saw over 550 automobile accidents on its roadways that were responded to by the Muncie Police Department. (Forty-one of these accidents were calls answered by Ball State University Police.)

Keller & Keller has investigated hundreds of accidents for residents who live in the city of Muncie and our experience has taught us that there are a large number of collisions in this area of the state and the injuries to those involved can prove traumatic, such as in the case example discussed below.

Known primarily as a manufacturing town in the past, Muncie’s job sector is now centered around health care, retail, education, and service-related businesses. The large number of jobs in the education sector is, of course, a result of Muncie being home to the Ball State Cardinals. The University also provides the city with an annual influx of student life beginning every fall, and the large student population also sees an increase in the number of alcohol and speed-related accidents on Muncie’s roadways.

Muncie Interstates and Highways

The largest number of calls our office receives from Muncie residents often involves car accidents that occur on Interstate 69 (I-69), which runs north and south near the western boundary of Delaware County. Speed and inclement weather conditions are often to blame for accidents occurring on I-69.

In addition to the heavily traveled I-69, there are two other major roadways that are the site of several accidents each year throughout Muncie and Delaware County, one being Highway 35 (US 35) and the other State Road 32. US 35 runs north and south to the east of downtown Muncie while State Road 32 cuts east and west through downtown Muncie. We have investigated and received calls from several Muncie residents involved in accidents on these roadways.

Example of Muncie Accident Case

We received a phone call from a Muncie resident whose sister-in-law had been in a serious accident in Delaware County and suffered traumatic injuries.

According to the police report and statements, our client was traveling eastbound on State Road 32, nearing County Road 800 East, where she was attempting to slow to turn northbound. However, before she could make her turn onto County Road 800, she was struck from behind by a vehicle that was following to closely. The impact occurred on our client’s right rear bumper, sending her careening into the westbound lanes of State Road 32.

Unfortunately, a vehicle traveling west on SR 32 was unable to avoid our client’s vehicle, striking her in the passenger’s side door, ultimately sending her car into a ditch on the northwest corner of the intersection.

The second impact was tremendous, causing multiple, severe injuries to our client. In fact, her injuries were deemed so severe that after being transported by ambulance to Ball Memorial Hospital in Muncie and being declared stable, she was then lifelined to Methodist Hospital in Indianapolis. Upon arrival at Methodist Hospital, our client underwent immediate surgery on her right arm and back. She also underwent surgery on her left leg and hip and had multiple pieces of hardware installed, including a stabilizer that would later require another surgery for removal. 

The seriousness of her injuries left her non-weight bearing for over 3 months and required her to undergo daily sessions of physical therapy. (In addition, it was also found that she had suffered a break to her collarbone, right wrist, and multiple broken bones in her right knee.)

Our first action as her attorney was to secure liability so that 100% of the fault would be placed on the adverse driver for following too closely. Once this was accomplished her attorney monitored her treatment and progress, handled all of the paperwork, and began corresponding with the insurance company to determine the amount of insurance coverage that was available.

Ultimately, we were able to secure a settlement on our client’s behalf as well as reduce her liens so as to maximize her recovery.
